General Terms and Conditions of Dometic E-commerce AB

1 Introduction

1.1 These General Terms and Conditions ("GTC") of Dometic E-commerce AB("Dometic") define the special terms to which consumers within the meaning of § 13 BGB ("You"/”Your”) may order products including spare parts ("Products") within the Federal Republic of Germany via Dometic's e-commerce website (https://www.dometic.com/en-de) ("Dometic Online"). For the avoidance of doubt, companies within the meaning of Section 14 of the German Civil Code (Bürgerliches Gesetzbuch – BGB) are not entitled to order products via Dometic Online.

Additional product and warranty information (including product specifications) can be found on the Dometic Online product page(s).

1.2 In addition, the following additional terms and conditions available on the Dometic website https://www.dometic.com ("Terms") apply to Your use of Dometic Online and Your order:

1.4 By checking the box "I agree" in the checkout process and submitting the order, You accept these Terms and agree to be bound by them. Please make sure that You have read and understood the GTC and the Terms before placing Your order.

1.5 By accepting these GTC, You confirm that You are at least 18 years of age or of legal age and/or otherwise have the right to enter into a binding contract pursuant to applicable law.

1.6 Any contractual terms and conditions that deviate from the GTC, in particular those that You declare applicable together with the acceptance of the contract, shall only be valid if and to the extent that they have been expressly accepted by Dometic in writing.

1.7 Dometic may change the GTC at any time. Contracts already concluded are not affected. The version of the GTC applicable to Your order is the one available on Dometic Online at the time of Your order.

2 Ordering products/reservation of self-supply

2.1 The presentation of products on Dometic Online does not constitute a legally binding offer, but an invitation to order.

2.2 The ordering of products and the conclusion of the purchase agreement for products is carried out according to the following procedure:

(i) Once You have selected the products, place Your order by going to checkout. A series of instructions on Dometic Online will guide You through the purchase process. You can add products to Your shopping cart without obligation and correct Your entries at any time before submitting Your order by using the correction tools provided and explained in the order process. By confirming that You have read these GTC and by clicking the “Zahlungspflichtig bestellen” button You agree that Your order constitutes a payment obligation for the products ordered. You also agree that Your order constitutes an offer to purchase the products listed in Your order in accordance with these GTC and the Terms and that a binding contract between You and Dometic will be concluded if and when the order is accepted by Dometic (order confirmation). Although Dometic will make every effort to deliver all products ordered, Dometic is free not to accept Your order, e.g. even if the products are no longer available.

(ii) You will receive an e-mail after completion of the order with an order confirmation detailing the Products that You have ordered. Please save Your order number for future reference.

After receipt of the order confirmation, the contract for the purchase of the product(s) is concluded. However, the actual shipment will only take place as soon as the conditions according to section 3.1 and 3.2 are met. If the Product(s) You ordered are not available because Dometic is not supplied by its reliably selected supplier through no fault of its own, despite having placed a congruent order in good time, Dometic will inform You immediately. Dometic will then be released from its obligation to perform and may withdraw from the contract. If You have already made payments, Dometic will reimburse You immediately. Dometic will ensure prompt delivery, subject to Dometic's own supplies. If a part of the order cannot be delivered immediately because Dometic is not supplied in time by its reliably selected supplier through no fault of its own, despite having placed a congruent order on time, Dometic will deliver the remaining products without charging the shipping costs again, provided this is reasonable for You. You may also decide to cancel the remaining ordered quantity part of Your order or cancel Your order in its entirety.

(iii) After confirmation and acceptance by Dometic in accordance with the terms and conditions described above, Your order cannot be changed unless You have made a different agreement with Dometic. Your statutory right of cancellation under clause 5 remains unaffected.

(iv) Once Your order has been confirmed and accepted by Dometic in accordance with the terms and conditions described above, it can no longer be cancelled, except by exercising Your right of cancellation in accordance with section 5, or according to what is set out in section 4.2 below, or in the event of force majeure in accordance with section 8.

2.3 The contract is concluded in the German language.

3 Delivery

3.1 Dometic will arrange for the products to be shipped to You using the shipping option You selected during the ordering process. Delivery is only possible within Germany.

3.2 Dispatch and delivery dates are only estimates and cannot be guaranteed. If no delivery times are indicated under Dometic Online, or if there are no deviating delivery times, these are approx. 2-4 days from payment as per section 4. If the products are not available within these estimated delivery times, Dometic will inform You using the contact information You provided.

3.3 Ownership of the Products will pass to You, regardless of the delivery date of such Products, when the purchase price due for such Products has been paid in full.

3.4 Delivery is completed when Dometic delivers the products as ordered to the address You have provided. If no one is available at Your address to receive the delivery, reasonable steps will be taken to attempt to deliver the delivery. You agree to reimburse Dometic for any additional shipping/handling costs incurred by Dometic as a result of Your failure to accept delivery in accordance with the agreed delivery terms.

4 Prices, delivery costs and payment

4.1 The prices applicable to the products ordered are indicated on Dometic Online and are confirmed in the order confirmation. All prices are displayed in Dometic Online's local currency, including the applicable statutory VAT (if applicable) and other price components, but excluding shipping and handling costs. These will be added to Your shopping cart and displayed broken down before You complete Your order and agree to these terms and conditions.

4.2 Although Dometic uses its best efforts to ensure that all prices on Dometic Online are correct, errors may occur (e.g. for technical reasons such as network failures, transmission errors, etc.). If Dometic detects a significant typing or printing error, for example in advertisements or on Dometic Online, which deviates by more than 70% from the usual sales price, Dometic reserves the right to cancel the order unilaterally. This also applies if You have already received an order confirmation. In such a case, Dometic will inform You as soon as possible and give You the opportunity to reconfirm Your order at the correct price or to cancel the order.

4.3 The available payment methods are presented to You on Dometic Online in the checkout process. Your credit or debit card will be charged and the bank transfer shall be effected, respectively, upon shipment.

Dometic reserves the right to not always offer all payment methods and to offer another payment method if the one You have chosen does not work for any reason at the time of purchase or if You are not approved for the chosen payment method. When paying for Your order, You confirm that You have the right to use the chosen payment method.

4.4 Through our collaboration with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer several payment options. Information about the available payment options with Klarna can be seen on Dometic Online before You proceed with Your purchase.

For more information about the above payment options with Klarna and Klarna´s Terms and Condition, please visit www.klarna.com or contact Klarna's customer service. We recommend that You read these Terms and Conditions carefully, as they form the basis of a contract between You and Klarna. Please note that Dometic cannot accept any liability or responsibility for third-party payment solutions.

In order for us to be able to offer the payment options with Klarna, we need to transfer Your personal, contact and order information to Klarna and their possible subcontractors. 4.5 By placing an order via Dometic Online You confirm that the payment details provided in Your order are valid and correct and that You are authorised to use a credit or debit card for payment.

4.6 Dometic reserves the right to assign or pledge to third parties any due purchase price claims against You in connection with delivered orders, including any instalments due, default interest and reminder fees.

5 Cancellation policy/right of cancellation for consumers

As a consumer within the meaning of § 13 BGB, You have the right to cancel this contract within thirty days without giving reasons.

The withdrawal period is thirty days from the day on which You or a third party designated by You, other than the carrier, took or has taken possession of the last goods

In order to exercise Your right of cancellation, You must inform us (Dometic E-commerce AB, Hemvärnsgatan 15, SE 171 54 Solna, Sweden, email contact.eu@dometic.com, phone: +49 (0) 511 47 40 46-400) by means of a clear statement (e.g. a letter or email sent by post) of Your decision to cancel this contract. You can use the attached sample revocation form for this purpose (which You can also find here), but this is not mandatory.

In order to comply with the revocation period, it is sufficient to send the notification of the exercise of the right of revocation before the end of the revocation period.

Consequences of revocation

If You revoke this Agreement, we shall reimburse You for all payments we have received from You, including delivery charges (other than any additional charges arising from Your choosing a different method of delivery from the cheapest standard delivery offered by us), immediately and no later than fourteen days from the date on which we receive notice of Your revocation of this Agreement. For this refund, we will use the same means of payment that You used for the original transaction, unless expressly agreed otherwise with You; in no event will You be charged for this refund. We may refuse to make any refund until we have received the goods back or until You have provided proof that You have returned the goods, whichever is earlier.

You must return or hand over the goods to us without delay and in any case within fourteen days at the latest from the day on which You inform us of the cancellation of this contract. This period shall be deemed to have been observed if You dispatch the goods before the expiry of the fourteen-day period. You shall bear the direct costs of returning the goods. The costs are estimated at a maximum of approximately EUR 200.00.

You shall only be liable for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary for the purpose of checking their nature, properties and functioning.

No right of withdrawal: The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

6 Inspection, installation and use

6.1 You are responsible for the proper installation and use of the products You have purchased from Dometic Online. For proper instruction You must always read and follow all instructions on the packaging of the products as well as the relevant Dometic user/product manual and installation instructions. This information is included with the products and can be found online on the respective product website at https://www.dometic.com/de-de/.

6.2 Spare parts purchased through Dometic Online must always be installed and used in accordance with the relevant Dometic user manual and installation instructions for the product in which You intend to install and use the spare parts.

7 Warranty

7.1 Dometic provides warranty by remedying defects. This is done, at Dometic's option, by way of subsequent performance, i.e. removal of a defect (rectification) or delivery of a defect-free item (replacement). Products returned by You become the property of Dometic again.

If the supplementary performance fails, You are entitled to self remedy, reduction or withdrawal from the contract in accordance with the statutory provisions. The right to withdraw from the contract does not apply in case of insignificant defects.7.2 The Products may also be subject to a supplementary manufacturer's warranty in accordance with the terms and conditions of the warranty card that accompanies the Product. Your statutory warranty claims shall apply additionally in any case.

7.4 For compensation or reimbursement of Your futile expenses, the limits set out in the following clause 8 (exclusion and limitation of liability) shall apply.

8 Limitation of liability; force majeure

8.1 With the exception of the following provisions, You have no right to claim damages from Dometic. This does not apply to claims for damages arising from injury to life, body or health or from the breach of material contractual obligations ("cardinal obligations"), nor to liability for other damages resulting from a wilful or grossly negligent breach of duty by Dometic, its legal representatives or vicarious agents. Essential contractual obligations (cardinal obligations) are those whose fulfilment is essential for the proper execution of the contract and on whose compliance You as a customer and can trust

8.2 In the event of a breach of material contractual obligations, Dometic shall only be liable for the foreseeable damage typical for the contract if it was caused by simple negligence, unless claims for damages are based on injury to life, body or health.

8.3 The limitations of liability set forth in paragraphs 8.1 and 8.2 shall also apply in favor of Dometic's legal representatives and vicarious agents if claims are made directly against them.

8.4 The limitations of liability resulting from paragraphs 8.1 and 8.2 shall not apply if Dometic has fraudulently concealed defect or has assumed a guarantee for the quality of the item. The provisions of the Product Liability Act shall also remain unaffected.

8.5 Dometic shall not be liable or responsible for any failure to perform or delay in performing Dometic’s obligations under these GTC in connection with any event beyond its reasonable control, including but not limited to acts of God, fire, flood, tempest, disaster, explosion, war (whether declared or not), acts of terrorism, labour disputes (whether or not involving its employees), pandemics or epidemics, difficulties in delivering caused by any circumstance referred to in this section that affect Dometic or any of its sub-contractors, or acts of governmental or other competent authorities, resulting general delays in transportation and other force majeure events.

9 Data protection

9.1 Your data necessary for order processing will be processed and stored by Dometic in accordance with the General Data Protection Regulation (“GDPR"). All personal data will be treated confidentially. You have a right to information and a right to correct, block or delete Your stored data.

10 Governing law; place of jurisdiction, dispute resolution

10.1 These GTC and any contract concluded on the basis thereof shall be governed by the laws of Sweden to the exclusion of the conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply. The statutory provisions restricting the choice of law and the applicability of mandatory (consumer protection) regulations, in particular those of the state in which You as a consumer have Your habitual residence, shall remain unaffected.

10.2 Dometic does not participate in resolution procedures before a consumer arbitration board and is not obliged to do so (§ 36 VSBG - Verbraucherstreitbeilegungsgesetz).

10.3 Amendments and supplements to these GTCs must be made in text form. This also applies to this agreement on text form itself. The precedence of the individual agreement according to § 305b BGB remains unaffected.
